Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Baddie Protocol iOS application and related services (the “Service”), provided by Baddie Protocol (“we,” “us,” or “our”). By creating an account or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

You must be at least 13 years old (or the minimum age required in your country) to use the Service. By using the Service, you represent that you meet this requirement and that you are legally permitted to enter into these Terms.

You sign in with Apple. You are responsible for safeguarding the Apple ID associated with your account and for activity that occurs under it. Notify us promptly of any unauthorized use.

Baddie Protocol is a habit-tracking app, not a healthcare provider. The protocol tasks, suggestions, and content in the Service are for general informational purposes only and are not medical, nutritional, or fitness advice. Consult a qualified professional before starting any new exercise, diet, or wellness regimen. You assume all risk associated with your participation. If you experience pain, dizziness, or any other adverse symptom, stop and seek medical attention.

You retain ownership of the photos, captions, and other content you submit (“Your Content”). You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display Your Content solely to operate the Service for you and the friends you have chosen to share it with.

You represent that you have the rights to Your Content and that it does not violate any law or third-party rights.

You agree not to:

• Upload content that is illegal, harassing, sexually explicit, hateful, or that depicts a minor in a sexual manner.
• Impersonate another person or misrepresent your affiliation.
• Attempt to reverse engineer, decompile, scrape, or otherwise access the Service in an unauthorized way.
• Interfere with or disrupt the Service or the experience of other users.
• Use the Service to send unsolicited messages or spam friend invites.

We may suspend or terminate accounts that violate these rules.

When you add a friend via invite code, you share your current challenge attempt’s day number, task-completion state, display name, and profile picture with them. You can remove a friend at any time in the app to stop sharing.

Some features may require a paid subscription processed through Apple. Pricing, billing cycles, and renewal terms are presented at purchase. Subscriptions auto-renew until cancelled in your Apple ID settings. Refunds are handled by Apple under its standard policies.

The Service, including its software, design, trademarks, and content (excluding Your Content), is owned by us or our licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial use.

You may stop using the Service at any time and delete your account from the app’s settings. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Sections that by their nature should survive termination (e.g. disclaimers, limitation of liability) will do so.

The Service is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory. We disclaim all implied warranties of merchantability, fitness for a particular purpose, and non-infringement to the fullest extent permitted by law.

To the maximum extent permitted by law, in no event will Baddie Protocol, its affiliates, or its suppliers be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or relating to the Service. Our total liability for any claim arising out of or relating to the Service is limited to the greater of (a) the amount you paid us in the 12 months before the claim and (b) USD $50.

You agree to indemnify and hold harmless Baddie Protocol and its affiliates from any claim, demand, or expense (including reasonable attorneys’ fees) arising from Your Content, your use of the Service, or your violation of these Terms.

We may modify the Service or these Terms at any time. Material changes will be communicated through the app or by email when applicable. Your continued use of the Service after the changes take effect constitutes acceptance of the revised Terms.

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. Disputes will be resolved in the state or federal courts located in Delaware, and you consent to personal jurisdiction there.

You acknowledge that these Terms are between you and Baddie Protocol, not Apple, and that Apple is not responsible for the Service or its content. Apple is a third-party beneficiary of these Terms and may enforce them against you. The Service must be used in compliance with the Apple Media Services Terms and Conditions.
